General Terms of Use for Sellintr.com

⦁ These terms of use apply until May 1st, 2024. The terms of use applicable from March 1st, 2024 can be found here.

The Sellintr.com, Y.Hisar mah. Antalya cad.no: 54/4 Manavgat/ANATALYA 07600, operates a website as well as other services, local and mobile applications, services and tools under the name “Sellintr.com” (hereinafter collectively “Sellintr.com Services”).

⦁ These General Terms of Use (hereinafter “Terms of Use”) contain the basic rules for the use of the Sellintr.com services. Terms and conditions of the user that deviate from these terms and conditions do not apply if they have not been confirmed in writing by Sellintr.com.

⦁ The Terms of Use and the Sellintr.com Services are provided exclusively in English, Russian, Arabic, Turkish and German languages.
If you use the Sellintr.com services as a consumer and conclude contracts for paid services with Sellintr.com, you have a statutory right of withdrawal, about which Sellintr.com informs you as follows:

⦁ § 1 Service description and advertising of the advertisements

⦁ 1 Sellintr.com service provides Sellintr.com, an online service through which the user as an advertiser can create and publish offers and requests consisting of texts and images (hereinafter “ads”), as well as advertisements published as an interested party other users can see. In addition, Sellintr.com Services also enable the exchange of electronic messages between advertisers and interested parties. To the extent necessary for conversion into file formats suitable for Sellintr.com Services, Sellintr.com will convert User's advertisements into formats for use in mobile applications and websites.
⦁ 2 The Sellintr.com services serve to publish advertisements and bring together providers and interested parties of the goods and services listed. Sellintr.com is not itself a provider of the products advertised in the advertisements.
⦁ 3 As part of the ad display and on a user's overview page, Sellintr.com displays additional information about the user and their activities in the Sellintr.com services (e.g. this can be information about the response rate and/or average response time to inquiries about published advertisements, so-called activity indicators). Sellintr.com can also identify the user based on certain criteria.
⦁ 4 Sellintr.com allows users to rate each other based on a concrete interaction with each other and in a publicly accessible manner. The use of the rating system is based on Sellintr.com's rating function principles.
⦁ 5 Sellintr.com allows users to follow other users or ads and to save search orders. Sellintr.com informs the user about items on the watch list, including changes in the description or price changes, about newly posted items from followed users and about new items that match a search request.
⦁ 6 Sellintr.com publishes and promotes the Sellintr.com services and the advertisements posted by users itself and through third parties, for example by incorporating the advertisements or excerpts thereof on websites, within software applications (“apps”), in emails, in print, radio and television marketing campaigns or in other media. Sellintr.com also allows third parties to promote their offerings and services through the Sellintr.com Services. Sellintr.com may also provide third parties with access to the data, information and content published through the Sellintr.com Services to support these activities. The user allows Sellintr.com to use its advertisements as mentioned above for the purpose of promoting and increasing the reach of Sellintr.com services. This also applies to translations for the purpose of integrating the translated advertisements into foreign language offerings.
⦁ 7 Sellintr.com's customer service is available to every user free of charge to submit complaints and other inquiries and also operates an internal complaint management system for commercial users. Customer service documents submitted complaints, examines them carefully and will take any necessary measures within a reasonable time frame and inform the user about this or the result of the complaint procedure. Sellintr.com regularly reviews its internal complaint management system and creates a report.
⦁ 8 Sellintr.com allows users to sort the search results based on various criteria (e.g. listing date, price). In addition, advertisements are also displayed in the search results for which the respective provider has agreed to pay an additional fee for their prominent display (e.g. as a top advertisement). More information about the possible options for highlighted display within the ad display.

§ 2 Registration, user account

In order to fully use the Sellintr.com services, in particular for posting advertisements, displaying certain contact details of advertisers and exchanging electronic messages with other users, the user must register with Sellintr.com. The prerequisite for registration is that the user is a natural person, legal entity or partnership. If the user is a minor, he or she may only register with Sellintr.com with the consent of their legal guardian. In this case, Sellintr.com reserves the right to make the provision of services dependent on the presentation of proof of consent from the legal guardian.
The user is obliged to provide truthful and complete data collected when registering with Sellintr.com. If the data changes after registration, the user is obliged to update the data immediately in the password-protected user area of the Sellintr.com services.
By submitting the registration form, the user makes an offer to conclude a user agreement with Sellintr.com, by which he accepts the validity of the terms of use and declares that he has read the data protection declaration. If Sellintr.com accepts the registration, the user will receive a confirmation email with a personalized link. Upon receipt of the confirmation email, a contract for the use of the Sellintr.com services (hereinafter “User Agreement”) is concluded between Sellintr.com and the user. To complete the registration, the user must access the link provided in the confirmation email and thus verify their email address. There is no entitlement to conclude a user agreement.
Upon successful registration, a user account is created for the user, which they can access using their email address and the password they chose during registration. The password can be changed by the user at any time via the password-protected user area. It must be kept secret by the user and protected from access by unauthorized third parties. If the user discovers or suspects that his access data is being used by a third party without authorization, he must inform Sellintr.com immediately and change his password immediately.
Each user may only register once with the Sellintr.com services for private use and for commercial or freelance use (“commercial users”) of the Sellintr.com services. User accounts are not transferable.
Sellintr.com may limit the use of certain features of the Sellintr.com Services or the extent to which individual features may be used to the fulfillment of additional requirements, e.g. B. the provision of additional data, an examination and verification of the user's data, the duration of use, the type of use (private/commercial), the user's previous payment behavior and/or make it dependent on the presentation of certain evidence.
Sellintr.com also reserves the right to test new or changed functions and features limited to certain user groups in order to improve the user experience, to the extent that this is reasonable for the users, taking into account Sellintr.com's legitimate interests. This can lead to different representations for different users.
⦁ 9 The user receives an overview of the advertisements he has published on his user profile page. He also receives information about his activity indicators and can make changes to his settings, preferences and data.
As part of the Sellintr.com Services, Sellintr.com has access to various information about users, including personal information. This includes, in particular, information that users transmit to Sellintr.com as part of the Sellintr.com services (e.g. contact or advertising information) as well as that generated during the provision and processing of Sellintr.com services (e.g. ratings, activity indicators or Communication). Users receive information through the Sellintr.com service that is necessary for the provision of the Sellintr.com service (in particular the messages and contact information of an interested buyer). Users also have access to important information they have submitted via the “My” area (particularly under messages, ads and settings).
Sellintr.com provides certain groups of users with analytical data about their activities and the advertisements they post. Sellintr.com will only pass on the advertisements, including the information about users contained herein and other information from the Sellintr.com services to third parties or provide third parties with access to this information if this is necessary for the provision of the Sellintr.com service. Service is necessary (such as to increase the reach in the case of advertising the Sellintr.com service and publishing advertisements via third parties in accordance with Section 1 No. 7 of these terms of use) or Sellintr.com is legally or contractually entitled to do so.
Sellintr.com provides information about the processing of personal data by Sellintr.com, including transmission to third parties and the rights of the user as a data subject in the data protection declaration.
§ 3 Conclusion of advertising and service package contracts
If the user has successfully registered with Sellintr.com, they have the opportunity to create their own advertisements free of charge via the Sellintr.com services and publish them in the Sellintr.com services. Sellintr.com reserves the right to publish advertisements in certain categories only upon payment of a fee. Regardless of this, Sellintr.com reserves the right to limit the number of free advertisements published by a user within a certain period of time and to only offer the publication of additional advertisements upon payment of a fee. The user has the opportunity to select and book certain paid additional services when placing an ad or, if necessary, to book such additional paid services even after an ad has been published. Sellintr.com may offer service packages with special services or conditions for certain user groups and/or in certain categories.
By entering the ad data, possibly selecting additional paid services or selecting the desired service package and sending the corresponding form, the user makes a binding offer to Sellintr.com to conclude a contract for the temporary publication of the ad (hereinafter “Advertising Agreement”) or a service package (hereinafter “Service Package Agreement”) on the Sellintr.com Services, to which additional terms and conditions may apply. The process can be canceled at any time before sending the form by closing the browser window or the application. Before sending the form, the user also has the option of checking the content of the designed ad using a preview function and correcting their information if necessary.
Sellintr.com can accept the offer to conclude an advertising contract through a accept a separate declaration to the user or by activating the ad. When Sellintr.com accepts the offer, the advertising contract or the service package contract comes into effect. Sellintr.com is not obliged to accept contractual offers from the user.
The advertisement data is stored electronically. The user can manage his advertisements in the password-protected user area of the Sellintr.com services and, in particular, delete them there. The text of the advertising contract or the service package contract is not saved separately. However, the user can access the terms of use on which the advertising contract or the service package contract is based at any time via the sellintr.com website and then save them in a playable form.
Even after an advertising contract has been concluded, it is possible for technical reasons that the ad cannot be found immediately after activation via the category search or with the help of search terms within the Sellintr.com services.
The user is not permitted to offer or provide the purchased services to third parties without the consent of Sellintr.com; this applies in particular to services from a service package contract.
§ 6 Deletion of advertisements, blocking of users, other measures
Sellintr.com is entitled to delete advertisements or other user content posted on the sellintr.com services in whole or in part or to delay or not publish the user's advertisements or other content if there are concrete indications that the advertisement or the content violates these terms of use or legal requirements, or that the user has otherwise culpably violated contractual obligations. In such a case, Sellintr.com may also warn the user and/or temporarily or permanently exclude the user from using the Sellintr.com services. In the event of a temporary or permanent blocking, Sellintr.com will inform the user of this fact 30 days before the blocking takes effect and provide reasons for this on a permanent medium (e.g. email-Whats.app), unless there are compelling reasons to the contrary. The aforementioned period does not apply if the termination or permanent blocking occurs due to mandatory legal provisions or official orders or Sellintr.com can prove that the user has repeatedly violated these terms of use, which led to the termination or permanent blocking.
Sellintr.com also reserves the right not to publish advertisements or to remove them from the Sellintr.com services if there are indications that the advertised product is not freely available for sale or is otherwise being offered in an unlawful manner, or if there are indications that this is the case it is clear that the ad is intended to be or was placed for abusive purposes. Sellintr.com also reserves the right to exclude certain products from advertising and to remove corresponding advertisements if these products are typically advertised for abusive purposes.
If a user was identified by Sellintr.com Use of the Sellintr.com services is excluded or the user contract with the user has been terminated, the user may no longer use the Sellintr.com services with other user accounts, including user accounts that were created for third parties, and may not register for one again Register with the classifieds services.

§ 4 Content requirements for posted advertisements

The user is obliged to place each ad in the appropriate category and to describe their respective offer truthfully, stating all relevant features and characteristics, using words and, if possible, meaningful images. Sellintr.com can support the user, e.g. by suggesting a category or other features of the item on offer based on the specified title. The user is obliged to carefully check all entries and only accept appropriate suggestions for their ad.
When placing an advertisement, the user is also obliged to indicate whether he is publishing the advertisement privately or in the exercise of a commercial or independent professional activity. Sellintr.com can, under certain conditions, request that the user generally determine whether his user account is purely private orpurely commercially used.
The posting of advertisements, texts, images or other content that violates legal provisions, these terms of use, the rights of third parties or common decency is prohibited. In particular, it is forbidden to post content
-that violate copyright, trademark and competition law regulations or legal provisions for the protection of minors,
-that violates Sellintr.com's policy regarding prohibited content, or
-that contain untrue information or that is otherwise misleading.
Users who use the Sellintr.com services as commercial providers or for other business purposes are subject to special legal regulations. They are, among other things, obliged to fulfill the legal information obligations and in particular to provide a complete provider identification that meets the legal requirements. Further information can be found on the Sellintr.com help page. Sellintr.com assumes no liability for the accuracy or completeness of the information summarized there.
§ 5 Special obligations of the user
The user is obliged to refrain from any actions that could jeopardize the secure operation of the Sellintr.com services or harass other users or that otherwise go beyond the intended use of the Sellintr.com services. In particular, he is obliged to refrain from
-Send email advertising, WhatsApp, SMS advertising, chain letters or other harassing content,
-Send viruses or other technologies that may harm the Sellintr.com Services or the interests or property of other users,
-expose the infrastructure of the Sellintr.com Services to an excessive load or otherwise disrupt or jeopardize the functioning of the Sellintr.com Services,
-Reproduce, make publicly available, distribute, edit or otherwise use Sellintr.com content without the prior consent of Sellintr.com in a manner that goes beyond the intended use of the Sellintr.com services.
-to reproduce, make publicly available, distribute, edit or otherwise use the advertisements or other content of third parties without their prior consent in a way that goes beyond the intended use of the Sellintr.com services.
-use crawlers, spiders, scrapers or other automated mechanisms to access the Sellintr.com Services and collect content without Sellintr.com's express written consent,
-Information, particularly email addresses or telephone numbers, about others collect or use users without the users’ prior consent,
- Bypass measures designed to prevent or restrict access to the Sellintr.com Services.
The user is obliged to save and archive all data and information stored within the Sellintr.com services that he currently or may need for evidence preservation, accounting or other purposes on his own storage medium.

If a user has been excluded from using the Sellintr.com services by Sellintr.com or if the user agreement with the user has been terminated, the user may also use the Sellintr.com services with other user accounts, including user accounts that were created for third parties. no longer use or register for Sellintr.com services again.

⦁ § 7 Fees for registration (opening the user account)
Sellintr.com charges fees for certain services provided in connection with the Sellintr.com Services and the use of certain features of the Sellintr.com Services. Before each booking of a paid service, Sellintr.com will expressly inform the user of the cost and the amount of the costs incurred.
Prices quoted by Sellintr.com for the provision of its own services within the Sellintr.com Services are in TRY (TL). including statutory sales tax.
Agreed fees are due for payment immediately upon opening the Sellintr.com account and can be paid using the payment methods accepted by Sellintr.com. If Sellintr.com offers and accepts instant payment as a payment method of credit card and bank transfer.
§ 8 Liability of advertisements

The advertisements and other user content published on the Sellintr.com Services do not reflect the opinions of Sellintr.com and are not reviewed by Sellintr.com for their legality, accuracy or completeness. Sellintr.com does not guarantee the accuracy or completeness of the information contained in the advertisements, nor does it guarantee the quality, safety or legality of the goods or services offered by users.
Sellintr.com is liable in accordance with the statutory provisions for intent and gross negligence on the part of Sellintr.com, its legal representatives, executives or other vicarious agents. The same applies to the assumption of guarantees or other assumptions of liability regardless of fault, as well as to claims under the Product Liability Act or in the event of culpable injury to life, body or health. Sellintr.com is also fundamentally liable for simply negligent violations of essential contractual obligations caused by Sellintr.com, its representatives, executive employees and other vicarious agents, i.e. those obligations on whose fulfillment the user regularly relies for the proper execution of the contract can be trusted, but in this case the amount is limited to the typically foreseeable damage. Any further liability on the part of Sellintr.com is excluded.
To the extent that Sellintr.com's liability is excluded or limited, this also applies to the personal liability of its legal representatives, executives and other vicarious agents.

§ 9 Liability of the user

The user releases Sellintr.com from all claims against other users or other third parties due to an infringement of their rights by advertisements and other content posted by the user on the Sellintr.com services or due to the user's other use of the Sellintr.com services Claim Sellintr.com. The user assumes the costs of the necessary legal defense of Sellintr.com, including all court and legal fees at the statutory rate. The right to exemption does not exist if the user is not responsible for the infringement.
The user is obliged to protect Sellintr.com in the event of claims by third parties Upon request, to promptly and truthfully and completely provide all defense information necessary to examine the claims and defend against them.
Any liability of the user that goes beyond these regulations remains unaffected
§ 10 Termination of the user agreement

Unless otherwise agreed, e.g. as part of a service package, the user can terminate the user contract at any time in text form without observing a notice period. All you need to do is send a notice of termination by email to Sellintr.com customer service (service@sellintr.com) or by post to: Sellintr.com – User Inquiries, Y.Hisar mah. Antalya cad.no: 54/4 Manavgat/ANATALYA 07600. In the event of termination during an ongoing paid additional service, there is no entitlement to (pro-rata) repayment.
Sellintr.com can terminate the user agreement at any time with 30 days’ notice. If an agreement has been reached between the user and Sellintr.com about a paid additional service with a specific term and the agreed term only ends after the time specified in sentence 1, termination by Sellintr.com is only possible with a notice period of 30 days to the end of the agreed term of the additional service. For commercial users, Sellintr.com will give reasons for the termination on a durable medium (e.g. e-mail), whereby the reasons can arise from, among other things, Section 6 No. 1 and No. 2 of these terms of use. The user may no longer book any new services from Sellintr.com upon receipt of notice of termination declared by Sellintr.com. The deadline does not apply if the termination is based on mandatory legal provisions or official orders. Sellintr.com will provide the user with a separate reason for this, unless there are compelling reasons to the contrary. Sellintr.com's right to delete individual advertisements, to block users and to carry out other measures in accordance with Section 6 as well as the right to termination without notice for good cause remain unaffected.
Upon termination of the user agreement, all of the user's ongoing advertisements will be removed from the Sellintr.com services and the user's user account will be deactivated. From this point on, the user no longer has access to the user account. The user account and all of the user's stored data will be deleted no later than six months after termination of the contract. This does not apply to data that Sellintr.com is legally obliged to retain or has a legitimate interest in retaining, e.g. to prevent renewed registration after a legitimate blocking. Aggregated data generated through use can generally continue to be retained even after the end of the contract. Sellintr.com also reserves the right to irrevocably deactivate user accounts with incomplete registration data and user accounts that have been inactive for a period of at least 12 months and to delete. Sellintr.com will notify the user accordingly on a durable medium (e.g. by email) at least 30 days before the user account is deleted.
§ 11 Data protection

Detailed information on the collection, processing and use of the user's personal data in connection with registration, execution of the user agreement and use of the Sellintr.com services can be found in Sellintr.com's privacy policy.
§ 12 Changes to the terms of use
Changes to these Terms of Use apply:
On the one hand, the user can agree to the changed terms of use by accepting them by posting an ad or inquiring about an advertisement; Sellintr.com will then specifically mark this with a corresponding note. On the other hand, Sellintr.com may propose a change to these Terms of Use to the User at any time. Changes to these terms of use will be offered to users in text form (e.g. by email) no later than 30 days before the proposed effective date. The user's consent is deemed to have been given if the rejection is not communicated to Sellintr.com in text form before the proposed date on which the changes take effect. If the user does not agree with the changes, he or she has the right to terminate the contract without notice and free of charge until the proposed date of entry into force. Sellintr.com also specifically informs the user in the message with which the changes are offered the right to refuse, the deadline for doing so and the possibility of termination. The modified Terms of Use will also be published on the Sellintr.com website.

§ 13 Exercise of rights by third parties, assumption of contract
For the purpose of fulfilling the contract and exercising the rights arising from this contract, Sellintr.com may use other affiliated companies.
Sellintr.com is entitled to transfer its rights and obligations from this contractual relationship in whole or in part to a third party with a notice period of four weeks. In this case, the participant is entitled to terminate the user agreement.
§ 14 Final provisions

The law of Turkey applies exclusively to the terms of use, the user agreement and all agreements based thereon between Sellintr.com and the user. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. If the user acts as a consumer, the mandatory consumer protection regulations that apply in the country in which the user has his or her habitual residence also apply, provided that these provide the user with further protection.
If the user is a merchant within the meaning of the Commercial Code, a special fund under public law or a legal entity under public law, the place of jurisdiction is Manavgat / Antalya, the exclusive place of jurisdiction for all disputes arising from the user agreement and the agreements based thereon. The same applies if the participant has moved his place of residence abroad after the contract has been concluded. For users who are consumers, the place of jurisdiction is the user's respective place of residence. For all disputes arising from the user agreement and these terms of use, the additional pSellintr.com is neither willing nor obliged to take part in dispute resolution proceedings with consumers before a consumer arbitration board (Section 36 Paragraph 1 No. 1 VSBG).
Sellintr.com is willing to cooperate with the mediators listed here to reach an out-of-court settlement of any disputes with Commercial Users; However, before initiating such mediation proceedings, commercial users should try to clarify their concerns with Sellintr.com's customer service (see §1 No. 7 of these terms of use).
Should individual provisions of these terms of use be or become wholly or partially void or ineffective, this will not affect the effectiveness of the remaining provisions. Statutory law shall take the place of provisions that are not included or are ineffective in these terms of use. If such statutory law is not available in the respective case (loophole) or would lead to an unacceptable result, the parties will enter into negotiations to replace the omitted or ineffective provision with an effective regulation that comes as close as possible to it economically. lace of jurisdiction for consumers is Manavgat/Antalya.

Sellintr.com is willing to cooperate with the mediators listed here to reach an out-of-court settlement of any disputes with Commercial Users; However, before initiating such mediation proceedings, commercial users should try to clarify their concerns with Sellintr.com's customer service (see §1 No. 7 of these terms of use).
Should individual provisions of these terms of use be or become wholly or partially void or ineffective, this will not affect the effectiveness of the remaining provisions. Statutory law shall take the place of provisions that are not included or are ineffective in these terms of use. If such statutory law is not available in the respective case (loophole) or would lead to an unacceptable result, the parties will enter into negotiations to replace the omitted or ineffective provision with an effective regulation that comes as close as possible to it economically.
